    Understanding the Data Involved

    Microsoft 365 and other cloud platforms can be an excellent choice for serving your user data needs. However, legal data requires a specialized approach to ensure compliance and efficient eDiscovery. As we begin to understand that the requirements of each type of data are very different, we can appreciate that it is not ideal to comingle, rather uncoupling the user experience from legal offers many benefits.

    Understanding the difference between "suitable" and "unsuitable" data is paramount. This distinction is crucial for maintaining the chain of custody and ensuring that each piece of data finds its right place in the cloud, complying fully with legal standards.  

    “Suitable” Data  

    Defined as data belonging to an end user that can be directly mapped to a user in Microsoft 365.

    Migrating this data can be a straightforward process.   

     

    “Unsuitable” Data 

    Legal data (data used by the legal team to search and export for legal matters) is typically journal email data that was stored in a legacy email archive either on-premises or in the cloud.

    Microsoft 365 cannot read or process these data types natively making them “unsuitable”.

    Managing & Governing the Information 

    When researching the migration of legal data, you may find there are two popular options for getting that data into M365. Each method introduces complexities into legal workflows. Both methods significantly complicate the maintenance of data integrity and the legal discovery processes, and potentially increase the risk of non-compliance with regulatory standards.  Let’s look at both:

    Journal Explosion:

    Journal explosion, a method where journal data is expanded into individual mailboxes, is fraught with drawbacks.

    This approach can lead to significant increases in mailbox sizes, duplication of data, and inflated costs due to the unnecessary expansion of user accounts.

    Moreover, the duplication complicates legal reviews and escalates external review costs, as most legal service providers charge based on the volume of data.

    Journal Splitting:

    Journal splitting, the division of journal data into manageable chunks for migration into shared mailboxes, while somewhat more manageable, still introduces challenges.

    This method complicates eDiscovery due to the fragmented nature of the data, loss of custodian-based management and search, and increased risks of incomplete archiving if ongoing journaling is required.

    Additionally, it may introduce over-collection and over-retention of irrelevant data and may run afoul of compliance requirements due to potential oversights in data management.
